Abstract

O parecer tem por objetivo responder a seguinte consulta: "Considerando o art. 30, II, § 1º, I e II, da Lei 8.666/93 e o Edital de Concorrência 005/99, originário da Secretaria..., pode a Administração exigir em concorrência de obra e serviço de engenharia a capacidade técnico-operacional? Sendo possível tal exigência, além do interesse público, qual outra limitação existiria para os parâmetros de aferição dessa capacidade? A exigência do subitem 02, "d", item 03.02 do Edital acima indicado caracteriza ilegalidade?"
