Liberdade como capacidade em Amartya Sen desde sua crítica ao utilitarismo

Resumo

O artigo examina a argumentação utilizada por Amartya Sen para rejeitar o utilitarismo e a alternativa proposta pelo autor: a análise das liberdades entendidas como o conjunto de capacidades, isto é, das possibilidades concretas de as pessoas viverem a vida do modo como têm boas razões para quererem viver. Para tanto, o artigo inicia expondo as críticas senianas ao pensamento utilitarista nos domínios da ética e da economia. Em seguida, explora os conceitos de bem-estar, condição de agente, funcionamentos e capacidade, suas inter-relações e suas implicações téoricas. Ao final, o artigo explica a compreensão original de Amartya Sen sobre a liberdade. O percurso metodológico do artigo é a revisão bibliográfica, tanto na literatura primária, quanto na literatura derivada, com foco, neste caso, aos autores mais importantes que trabalham na perspectiva das capacidades, que consistem no referencial teórico do trabalho. Como isso, o artigo cumpre o objetivo de preencher uma lacuna teórica na literatura jurídica brasileira, que costuma se valer dos ensinamentos de Sen sobre desigualdade, desenvolvimento e justiça, mas com pouco acesso a textos em língua portuguesa que se debrucem sobre os conceitos essenciais e que demonstrem a evolução argumentativa do autor até a consolidação de sua noção de liberdade.
