Resumo

O desempenho da função regulatória, constitucionalmente orientada, é um dos tópicos mais fascinantes e complexos do constitucionalismo contemporâneo. Sem dúvida, as recentes crises econômico-financeiras e ambientais só tem mostrado a importância de encontrar a medida certa de intervenção estatal na arena do mercado para induzir o desenvolvimento sustentável. Neste artigo, apresentam-se as condições para uma regulação compatível com a Constituição, especialmente para corrigir as falhas de mercado e de governo.
